Arbitration Agreement

1AGREEMENT TO ARBITRATE

You and Dopecy agree that any dispute, claim, or controversy arising out of or relating to the following shall be resolved exclusively through final and binding arbitration, rather than in court:

• These Terms
• The Dopecy Platform
• Dopecy Services
• Payments, orders, or deliveries
• Privacy or data use
• Any relationship with Dopecy

2WAIVER OF JURY TRIAL

YOU AND DOPECY WAIVE ANY RIGHT TO A JURY TRIAL. All disputes will be resolved by a neutral arbitrator, not a judge or jury.

3CLASS ACTION WAIVER

YOU AND DOPECY AGREE THAT:

• Disputes must be brought on an individual basis only
• You may not bring claims as a plaintiff or class member in any class action, consolidated action, or representative proceeding
• The arbitrator may not combine or consolidate claims from multiple users

4INFORMAL DISPUTE RESOLUTION

Before filing arbitration, both parties agree to attempt to resolve disputes informally. You must send a written notice of dispute to Dopecy including:

• Your full name
• Account email
• Description of the dispute
• Requested resolution

5ARBITRATION RULES & PROVIDER

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or another mutually agreed arbitration provider. Unless otherwise agreed:

• Arbitration will be conducted in English
• Arbitration will take place in Delaware, or remotely if permitted

6ARBITRATOR AUTHORITY

The arbitrator shall have exclusive authority to resolve all disputes, including interpretation of this Agreement, enforceability of this Arbitration clause, liability issues, and damages or remedies. However, the arbitrator may not:

7COSTS OF ARBITRATION

Payment of arbitration fees will be governed by AAA rules.

• Dopecy may cover filing fees in certain cases
• Each party is responsible for its own legal fees unless otherwise required by law

8SMALL CLAIMS COURT EXCEPTION

Either party may bring an individual claim in small claims court instead of arbitration, provided the claim remains within that court's jurisdiction.

9OPT-OUT RIGHT

You may opt out of this Arbitration Agreement within 30 days of first accepting it. To opt out, send written notice to support@dopecy.com including your full name, account email, and a statement that you opt out of arbitration. If you opt out, you retain the right to sue in court.

10SURVIVAL

This Arbitration Agreement survives termination of your account, closure of the Dopecy Platform relationship, and completion of services.

11SEVERABILITY

If any part of this Arbitration Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

12GOVERNING LAW

This Arbitration Agreement is governed by the laws of the State of Delaware, without regard to conflict of law principles.

13RELATIONSHIP TO TERMS OF USE

This Arbitration Agreement is incorporated into and forms part of the Dopecy Terms of Use. In the event of conflict, this Arbitration Agreement governs dispute resolution.
